Abstract:

Resources are the basis for the economic development. How to make the legislations and policies for the effective utilization of resources has become an important issue. This paper firstly analyzes the severe situation of our natural resources, then discusses the system of China’s mineral resources industry, suggests in mineral resources industry treating all market players equally, eliminating improper restrictions on mining rights, lowering the tax burden on mining companies and enhancing mine environmental protection. China shall optimize the resources laws, manage the natural resources with different grades, ensure a marketing mechanism on resource prices, and carry out a strategy “attracting foreign investment and investing foreign”.

摘要：

资源是国民经济发展的基础和保障，如何对资源产业进行立法规划和政策调整以达到有效利用，已经成为关系国计民生的重要课题。首先分析了我国自然资源利用面临的严峻现状，然后以矿产资源产业法规和政策切入，讨论了我国矿产资源产业制度，建议我国在矿产资源产业中应给予各市场主体平等地位，消除矿业权流转的不当限制，降低矿山企业的税收负担，加大矿山环境保护力度。在此基础上，进行资源产业法规与政策的思考，认为我国应建立完善的资源产业法规体系，对自然资源实行分级分类管理，在资源产业中树立市场主体平等的观念并坚持市场价格对资源产业的引导，同时加大资源开发利用中对环境保护的力度，实行“引进来、走出去”的资源产业发展战略。 
