Abstract:

In countryside, it is hard to supervise peasants build houses through illegally-using lands. This paper analyzes the reasons and presents approaches to the illegally-using rural lands, which is significant to conserve plowlands, promote the extensive land utilization and mitigate the land supply and demands. This paper systematically summarizes the features, analyzes the reasons, combined with the policies and regulations, successful experiences and good methods, presents four measures including making village land using planning, conserving plowlands, improving peasant's building houses model and innovating land supervision mechanism.

摘要：

农村违法占地建房问题已经成为土地利用监管急需破解的难题。针对问题、分析原因、查找对策、有效遏制农村违法占地建房现象的发展势头，对于减轻耕地保护压力、促进土地集约节约利用、缓解用地矛盾有着极其重要的意义。本文系统总结了当前农村违法占地建房的几个特点，深刻剖析了出现大量违法占地建房现象的原因。结合国土资源管理法律法规政策要求和制度改革趋势，以及各地在实践中创造的好经验、好办法，提出了加快编制村级土地利用规划、严格落实耕地保护责任制、积极引导农民改进建房模式、不断创新土地执法监察机制等破解农村违法占地建房难题的4项对策。
