我国矿产资源开发中的政府协同监管机制研究

Abstract: This paper reviews the major governmental collaborative supervision practices in China’s mineral resources development, analyzes their issues and presents an overall framework and objective in optimizing the collaborative supervision, aiming at providing reference for China to optimize and develop supervision policy in mineral resources development. Liaison meeting, liaison enforcement and liaison documenting are three major governmental collaborative supervision forms. In this domain, governmental collaborative involvements lack laws basis, defected in collaborative flowchart and mechanism, and uncertainty arises from department or local benefits. To improve the general efficiency of governmental collaborative supervision in China’s mineral resources development, government needs to be granted the judgment, which needs supervising. Function of department needs to be defined on purpose. Such collaboration shall be of accountability, downward and upward. The existing mechanism shall be improved in many ways.

摘要: 系统梳理我国矿产资源开发监管领域中主要的政府协同实践形式,分析这些协同形式存在的问题,并在此基础上研究优化协同治理的总体框架和具体目标,以期为我国矿产资源开发监管政策的完善和发展提供参考建议。联席会议、联合执法和联合发文是矿产资源开发监管领域中的3种主要的政府协同机制。在该领域中,政府协同行为缺乏法律保障,协同流程不健全,协同机制自身存在缺陷,部门利益和地方利益的存在增加了协同的不确定性。为了提高矿产资源开发监管政府协同治理的整体效能,需要授予政府自由裁量权并加以监督,科学界定部门职能,建立自上而下和自下而上相结合的政府协同问责机制,并在完善现有协同机制的基础上多措并举。
