Abstract:

State’s ownership system of natural resources as a big part of natural resources property rights is a key content of natural resources laws. China ’s constitution has clear articles in defining state ’s ownership system of natural resources, which, however, has been changed a little such as loss of state ’s benefit rights. This paper, based on China’ sconstitution and establishment and its significance of state ’s ownership of natural resources, analyzes the changes in ownership and their aftermath, and presents suggestions on reconstruction of state ’s ownership of natural resources.

摘要：

国家自然资源所有权制度作为自然资源权属制度的重要组成部分，是自然资源法律制度中的重要内容。虽然我国宪法对自然资源国家所有权制度的内容作了明确的解释，然而，在具体实践当中，国家自然资源所有权制度却产生了一些异化现象，如国家自然资源收益权落空等。本文以我国宪法为依据，从国家自然资源所有权的确立及其意义入手，分析了我国国家自然资源所有权的异化表现及产生的后果，并基于以上分析就我国国家自然资源所有权重构问题提出一些看法和建议。
