Abstract:

This paper, based on a perplexing concept of basic farmlands, garden lands and wood lands due to agricultural adjustment, aims to clarify the definition of basic farmlands, by means of data review, theoretical study and logic analysis. The results indicate that the existing definition of basic farmlands can not meet the needs of practice, so it is necessary to redefine the basic farmlands, which shall not be occupied in a time or long term, well equipped with irrigation works, and can be altered or be excellent plantation, and its extension is a production base where can provide food and industrial materials, and its scope is enlarged to include garden lands besides other agricultural lands.

摘要：

由于生态退耕、农业结构调整等原因，当前基本农田保护理论和实践之间存在冲突，基本农田概念与园地、部分林地之间存在混乱关系，基于此，本文采用文献资料法、理论研究和逻辑分析法等，从基本农田与耕地、农田之间的逻辑关系、从耕地与园地（及部分林地）的关系以及从基本农田保护的目的能够达到、手段能够实施的角度分析，认为原有基本农田概念确实不能满足实践的需要，对基本农田概念进行理论探讨和调整是必要的。基本农田的内涵应该是国家长期或一定时期内不得占用的农田，是具有良好的水利与水土保护设施的、正在实施改造计划以及可改造的优质农田和潜在的优质农田，外延是提供食物和工业原料的粮、经、饲、园、绿、桑、茶、果和药的草本农作物和木本农作物等的生产基地，基本农田的范围由原来的耕地扩大到了园地等其他农用地类型。
